1. What CigarFlux is

CigarFlux is an online cigar comparison catalog. We publish product records, package formats, prices observed at third-party retailers, and availability information reported by participating stores and by visitors.

2. What CigarFlux is not

We do not sell tobacco. CigarFlux operates no store, holds no inventory, accepts no orders, takes no payment, ships nothing, and handles no returns. Every purchase is a transaction between you and the retailer, governed by that retailer’s own terms.

3. Eligibility and age

You must be at least 21 years old to use CigarFlux. By using the service you represent that you meet that requirement. We may refuse or terminate access where we reasonably believe it is not met. Our age and responsible-use practices are set out under What CigarFlux does not do.

4. Territory and governing law

CigarFlux is built for the United States market. The retailers, prices and availability it shows are United States ones, and the age check uses the United States minimum of 21. People elsewhere may view the site. Tobacco law differs from place to place: you are responsible for knowing and following the law where you are, including whether buying or importing a tobacco product is lawful for you. We are not a seller and ship nothing.

These terms are governed by the law of the United States and of the State in which we are established, without regard to conflict-of-law rules. If you use this service from outside the United States, these terms still apply to your use, and you are responsible for complying with the law where you are.

5. Prices and product information

A price shown on CigarFlux is a record of what a retailer published when we last observed it. It is not an offer, and it is not a guarantee that the price remains available. Prices, availability, and package contents change without notice.

Prices are compared only within one exact package format. A pack and a carton are treated as separate markets and are never averaged together. A specification no source has confirmed is left out rather than presented as fact.

Product descriptions are generally the wording of the retailer or manufacturer that published them, and brand histories are drawn from published sources. Descriptive or promotional statements in that wording are the publisher’s, not ours, and are not a health claim or a warranty.

6. Local availability

Availability information reflects what a retailer or a visitor reported, and when they reported it. It is evidence, not a reservation, and it does not commit any store to hold stock. Confirm with the retailer before traveling.

7. Acceptable use

You may browse the catalog, compare prices and package formats, save products to a watchlist, submit availability reports and corrections about products you have actually seen, write reviews of products you have used, and follow outbound links to retailers.

You may not:

• Submit false, misleading, or automated availability reports, prices, reviews, or corrections.
• Scrape, crawl, spider, or bulk-download the catalog, or use automated means to access the service, except as expressly permitted in writing.
• Circumvent or attempt to circumvent the age check, rate limits, access controls, the territory restriction, or any security measure.
• Access another person’s account, or share, sell, or transfer your own.
• Resell, republish, or redistribute the catalog, price data, or availability data, in whole or in substantial part.
• Submit content that is unlawful, defamatory, infringing, or that you do not have the right to submit.
• Introduce malware, attempt to disrupt or overload the service, or probe it for vulnerabilities without prior written authorization.
• Use the service to market tobacco to anyone under 21, or to misrepresent your age.
• Misrepresent an affiliation with CigarFlux, or use our name or marks without permission.
• Post threats, harassment, or content encouraging anyone to harm themselves or others.
• Post anyone’s email address, phone number, or other contact details, including your own, in a discussion.
• Post markup, scripts, or code, or more than one link in a single post.

Discussion posts are screened automatically when submitted. A post that breaks these rules may be refused with a reason, and a post that appears threatening is held for a moderator and not published. Posting is rate limited per account and per connection.

We may remove content, suspend access, or terminate an account where we reasonably believe these terms have been breached. Where the breach is not serious and can be corrected, we will ordinarily say so first.

8. Accounts

You are responsible for activity under your account and for keeping your credentials secure. You agree not to submit false availability reports, prices, or reviews; not to use automated means to access, scrape, or overload the service; not to circumvent rate limits, access controls, or the age check; and not to submit unlawful content or content you have no right to submit.

9. Retailers and participating stores

Participating retailers report the products they carry. Reporting is not an endorsement, and it does not affect ordering. Retailers see aggregate local demand only, never the identity of any visitor.

10. Affiliate relationships

CigarFlux participates in affiliate marketing programs. Certain outbound links to retailers are affiliate links, and where a qualifying transaction follows, we may receive a commission from the retailer or the network administering that program. Commission is paid by the retailer and does not affect the price you pay.

11. Intellectual property

Brand names, product names, and logos are the property of their respective owners and are used to identify products. Product photography is used only where we have the right to use it; where we do not, the record states that a visual is pending rather than displaying an image we cannot account for.

Content you submit remains yours. By submitting it you grant us a non-exclusive, worldwide, royalty-free license to display and distribute it in connection with the service.

12. Automated access

Automated collection is permitted only with prior written permission. We operate rate limiting and may block access that degrades the service for others.

13. Disclaimers and limitation of liability

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss arising from reliance on a price, specification, or availability record published here, or from any dealing with a retailer found through the service.

14. Health

Cigars are not a safe alternative to cigarettes. Nothing on CigarFlux is a health claim or a recommendation to use tobacco.

15. Indemnity

You agree to indemnify, defend, and hold harmless CigarFlux and its operators from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of or connected with: your use of the service; content you submit; your breach of these terms or of any applicable law; your dealings with any retailer reached through the service; or any misrepresentation you make, including as to your age.

We may assume the exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate with that defense. You may not settle any such matter without our prior written consent.

16. Changes and termination

We may modify these terms; material changes will be announced on the service and reflected in the version and effective date above. We may suspend or terminate access where these terms are breached.
